Welcome to Meow Merge , as used in these terms and conditions of use ("Terms"), "Paddy Panda", "we", "us", or "our" refer to Paddy Panda, an independent game development studio.

We provide our users ("Users") with: Meow Merge mobile game application available on Google Play and Apple App Store (the "Game" or "Application"). The Game and any related services are referred to herein as our "Services".

Please read these Terms carefully because they govern your access to and use of our Services and are legally binding. YOU ACKNOWLEDGE AND AGREE THAT, BY DOWNLOADING, INSTALLING, OR ACCESSING OUR SERVICES, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE OUR SERVICES.

Modification Paddy Panda reserves the right, at its sole discretion, to modify, discontinue or terminate our Services, including any portion thereof, on a global or individual basis, or to modify these Terms, at any time and without prior notice. If we modify these Terms, we will post these Terms as modified or otherwise provide you with notice of the modification. By continuing to access or use our Services after we have posted a modification to these Terms or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using our Services.
No Unlawful or Prohibited Use By using our Services, you represent and warrant to Paddy Panda that you will not use our Services, or any of the content obtained from our Services, for any purpose that is unlawful or prohibited by these Terms.
Eligibility and Registration YOU AGREE THAT IF YOU ARE UNDER THE AGE OF 18 OR WHATEVER IS THE AGE OF LEGAL MAJORITY WHERE YOU ACCESS THE SERVICES, YOU REPRESENT THAT YOUR LEGAL GUARDIAN HAS READ, UNDERSTOOD, AND AGREED TO THESE TERMS.
Privacy Use of our Services is also governed by Paddy Panda's Privacy Policy. Please note that:

No Game Progress Data Collection: Our Game is a client-side application without server infrastructure. We do not collect, store, or transmit any of your game progress data, scores, or in-game achievements.

Limited Data Collection: We only collect basic analytics data through Google Firebase SDK in accordance with Google's requirements and best practices. This includes anonymous usage statistics, crash reports, and device information necessary for the proper functioning of the Game.

Content Paddy Panda Content means text, data, graphics, images, illustrations, forms, documents, marketing materials, look and feel attributes, Paddy Panda or our licensors' trademarks and logos, the Game Application, and other content made available by Paddy Panda on or through our Services.
Ownership Our Services and Paddy Panda Content are protected by copyright, trademark, and other laws of the People's Republic of China and foreign countries. Except as expressly provided in these Terms, Paddy Panda and our licensors exclusively own all right, title and interest in and to the Services and Paddy Panda Content, including all associated intellectual property rights, including any patents, copyrights, trademarks, service marks, trade names, database rights, domain name rights, applications for any of the foregoing, moral rights and trade secret rights ("Intellectual Property Rights"). You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying our Services or Paddy Panda Content.
Paddy Panda Content License Subject to your compliance with these Terms, Paddy Panda hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access, view, download and use the Game solely for your personal and non-commercial purposes. You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services or Paddy Panda Content, except only as expressly permitted by these Terms. No licenses or rights are granted to you by implication or otherwise under any Intellectual Property Rights owned or controlled by Paddy Panda or its licensors, except for the licenses and rights expressly granted by these Terms.
General Prohibitions You agree not to do any of the following while using our Services or Paddy Panda Content:

Use, display, mirror, frame or utilize framing techniques to enclose our Services, or any individual element or materials within our Services, Paddy Panda's name, any Paddy Panda or Paddy Panda licensor's trademark, logo or other proprietary information without Paddy Panda's express written consent;

Attempt to probe, scan, or test the vulnerability of any Paddy Panda system or network;

Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Paddy Panda;

Attempt to access or search our Services or Paddy Panda Content through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software provided by Paddy Panda;

Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide our Services or Paddy Panda Content;

Use cheats, exploits, hacks, bots, mods or third party software designed to gain an advantage, perceived or actual, over other Users, or modify or interfere with the Service;

Abuse or exploit a bug, glitch or mechanism in the Service; or

Engage in any fraudulent behavior.

Disclaimers OUR SERVICES AND PADDY PANDA CONTENT ARE PROVIDED AS IS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, PADDY PANDA EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. PADDY PANDA MAKES NO WARRANTY THAT OUR SERVICES OR PADDY PANDA CONTENT WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. PADDY PANDA MAKES NO WARRANTY REGARDING THE QUALITY OF ANY PRODUCTS, SERVICES OR CONTENT OBTAINED THROUGH OUR SERVICES OR THE ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH OUR SERVICES. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM PADDY PANDA OR THROUGH OUR SERVICES OR PADDY PANDA CONTENT, WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
Limitation of Liability YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF OUR SERVICES AND PADDY PANDA CONTENT THEREIN REMAINS WITH YOU. NEITHER PADDY PANDA NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING OUR SERVICES OR PADDY PANDA CONTENT WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE OUR SERVICES OR CONTENT THEREIN, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT PADDY PANDA HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

IN NO EVENT WILL PADDY PANDA'S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE OUR SERVICES OR PADDY PANDA CONTENT THEREIN OR PROVIDED THEREBY EXCEED ONE HUNDRED U.S. DOLLARS ($100). THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN PADDY PANDA AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, AND SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Indemnity You agree to defend, indemnify, and hold Paddy Panda, its officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to our Services or Paddy Panda Content, or your violation of these Terms.
Governing Law and Dispute Resolution These Terms and any action related thereto will be governed by the laws of the People's Republic of China, without regard to its conflict of laws provisions.
Entire Agreement These Terms constitute the entire and exclusive understanding and agreement between Paddy Panda and you regarding our Services and Paddy Panda Content, and these Terms supersede and replace any and all prior oral or written understandings or agreements between Paddy Panda and you regarding our Services and Paddy Panda Content.
